Do I have to disclose well or water supply problems when selling in Pennsylvania?

A plain-language answer for Pennsylvania homeowners, with the official sources listed below. Reviewed October 2026.

Short answer

Yes, if you know of them. Section 7304 of the Pennsylvania Real Estate Seller Disclosure Law includes water and sewage systems or service among the subjects on the form. Section 7308 says you need not investigate, but you cannot knowingly hide a material defect or give false answers.

The disclosure duty

Section 7303 says a seller who intends to transfer an interest in real property must disclose to the buyer material defects known to the seller. Section 7304 lists the subjects the form must address, including water and sewage systems or service. A private well, a shared well and a public hookup are all water systems you may need to describe accurately.

What counts as known

The law does not require special testing. Section 7308 says no specific investigation or inquiry is required, yet the seller must not knowingly conceal a material defect. If you have had a bad test result, low flow, a pump replacement or a treatment system, those are things you know. Put them in writing on the form.

Buyer testing

Buyers often order a water test through the agreement of sale. Their results can reveal issues you did not know about. Section 7309 says sellers have no liability for errors they did not know about. Do not hide records, though, because actual knowledge changes the analysis.

Keep paperwork

Gather well records, pump invoices and any lab reports. This page is general information and not legal advice. A Pennsylvania real estate attorney can tell you how to word the form. If the water supply is shared with a neighbor, include any written agreement about maintenance and costs. Buyers and their lenders will want to see who is responsible for the pump and the line.

Selling for cash instead

If a failing well makes a retail sale tough, an as-is cash offer is another way to compare. If you want a direct sale, Kaizen Home Buyers can make a cash offer on the house exactly as it stands. There are no repairs and no agent commission. An offer can come within 24 hours, and closing takes 14 to 30 days or lands on your date. The number is 267-329-0084.
