Do I have to test my septic system before selling in Pennsylvania?

A plain-language answer for Pennsylvania homeowners, with the official sources listed below. Reviewed October 2026.

Short answer

The seller disclosure law does not require you to investigate. Section 7308 says a seller is not obligated to make any specific investigation, but must disclose known defects. The form covers water and sewage systems. Local rules and buyer inspections can still require testing, so check with your municipality.

What state law says

Pennsylvania's Real Estate Seller Disclosure Law lists water and sewage systems or service among the subjects a disclosure must address under section 7304. Section 7308 says the seller is not obligated by the chapter to make any specific investigation or inquiry, but may not knowingly conceal a material defect or make false representations. So the statute asks what you know, not what a test would find.

Where a test usually comes from

A buyer commonly asks for a septic inspection through the agreement of sale. A lender may set conditions. A municipality may have its own resale rules, as some townships do for sewer connections. The Perkiomen Township form, for example, asks whether sewer is public or private. Check your municipality before assuming nothing is required.

What to disclose

If you know of backups, slow drains, a past repair or a failed system, write that down. If you have records of pumping or repairs, attach them. A clear paper trail helps a buyer decide and protects you later. Section 7311 allows actual damages to a buyer, with a two-year limit from settlement.

Next steps

Ask your agent or attorney whether to order a septic inspection before listing. A cheap inspection can avoid a surprise during the buyer's due diligence period. This page is general information and not legal advice. Many sellers also pump the tank before listing and keep the receipt. It is a small cost that shows the system has been looked after, and it answers a question buyers almost always ask.

Selling for cash instead

If a septic system looks like trouble, some owners compare selling as-is to paying for a replacement. Kaizen Home Buyers buys houses for cash, as-is, with no repairs and no agent commission.
