Can I evict a tenant in Delaware so I can sell the house?

A plain-language answer for Delaware homeowners, with the official sources listed below. Reviewed October 2026.

Short answer

Not just because you want to sell. Delaware's landlord-tenant chapter has specific grounds and notice rules, such as at least 7 days' notice for unpaid rent under section 5502, and section 5516 bars retaliatory actions. A lease usually continues unless it ends or the tenant breaches it. See an attorney first.

Grounds matter

Title 25, chapter 55 sets the rules for summary possession. For nonpayment, section 5502 says payment must be made within the time stated in the notice, which must be not less than 7 days after the notice was given or sent, before the landlord may file. A sale plan alone is not a ground we found in the pages reviewed, so look to the lease and the statute.

Retaliation

Section 5516 describes retaliatory acts, including pursuing summary possession after a tenant has complained or taken certain legal steps. Timing can look suspicious if a landlord files right after a repair request. Courts can read that as retaliation, so document your reasons.

Better options for many sellers

If the tenant is paying and the lease runs for a while, selling subject to the lease can work. If you need the house empty, an agreed move-out in writing, with a date and any payment, is cleaner than a contested filing. The buyer may also want to see the lease and the deposit records before closing. Whichever route you choose, keep copies of every notice, text and receipt. If the matter ever reaches a courtroom, a neat paper trail is the first thing a judge looks for.

Talk to counsel

Landlord-tenant cases are strict about procedure. A mistake in the notice can restart the clock. This page is general information and not legal advice. Ask a Delaware landlord-tenant attorney which route fits your lease and your timeline.

Selling for cash instead

If a tenant is the obstacle, selling as-is to a buyer who accepts the occupancy may be simpler. Kaizen Home Buyers is one option to compare. We pay cash, buy as-is and charge no agent commission, so you do not fix anything first. We can send an offer within 24 hours and close in 14 to 30 days or on your schedule. Call 267-329-0084.
