Short answer
Section 5509 requires at least 48 hours' notice of the landlord's intent to enter, except for repairs the tenant requested, and entry only between 8:00 a.m. and 9:00 p.m. A showing for buyers needs that notice each time, so build the schedule around the tenant.
The statute
Title 25, section 5509 of the Delaware Code states that the landlord must give the tenant at least 48 hours' notice of the landlord's intent to enter, except for repairs requested by the tenant, and may enter only between 8:00 a.m. and 9:00 p.m. A buyer or agent entering for a showing is entering with the landlord's permission, so plan as if the landlord's duty applies.
Building a showing schedule
Give written notice that lists the date and time window. Offer a few set showing slots instead of daily requests. Agents often prefer a lockbox, which is a problem in a tenant-occupied home, so use accompanied entry instead. Check your lease for extra terms about access. Put your showing rules in a short written schedule and hand a copy to the tenant and to every agent. Clear rules cut down on missed appointments and on arguments about who promised what.
Avoid retaliation problems
Section 5516 prohibits retaliatory acts, such as pursuing summary possession after the tenant has complained or used legal rights. A tenant who refuses unreasonable showings should not face a sudden eviction notice. Keep requests polite and documented.
Consider a tenant-friendly path
Some landlords sell with the tenant in place and let the buyer inherit the lease. Others offer a move-out incentive. Talk with a Delaware attorney before offering money, and put any agreement in writing. This page is general information and not legal advice.
Selling for cash instead
A cash buyer who accepts the property as-is may need fewer showings. If you want a direct sale, Kaizen Home Buyers can make a cash offer on the house exactly as it stands. There are no repairs and no agent commission. An offer can come within 24 hours, and closing takes 14 to 30 days or lands on your date. The number is 267-329-0084.
