Official pageThe Mercer County Surrogate's Court is in the Civil Court House on South Broad Street in Trenton. The county describes the Surrogate as a judge of that court under the New Jersey Constitution, who rules on whether a will is valid and gives the executor proof of authority to run the estate. Without that proof, a house usually cannot be sold on the estate's behalf. This page follows the steps in order.
No obligation. We respond within 24 hours.
Mercer estates often include an older Trenton rowhouse or multifamily, a Hamilton or Ewing township home that sat through years of deferred upkeep, or a house with back taxes and tenants. Each of those adds tasks. This is general information, not legal or tax advice. An estate attorney should confirm how the rules apply to you.
Find the original will and certified death certificates. For a Trenton rowhouse or multifamily, also look for the deed, tax bills, any mortgage statement and the leases. Back taxes and open balances change what a sale can pay off, so know them early.
The Surrogate's office is on the fourth floor of the Civil Court House at 175 South Broad Street. The listed number is (609) 989-6331. Call before you go to confirm hours and what to bring, since the excerpt we read does not publish a checklist.
Mercer's page says the court handles probate of wills, qualifies trustees of testamentary trusts, and appoints administrators or affiants where no will exists. With a will, the Surrogate passes on its validity and gives the executor proof of authority. Without one, an administrator is appointed.
Class A heirs, including a spouse, civil union or domestic partner, child, grandchild, parent, grandparent and stepchild, pay nothing. Siblings are Class C, with the first $25,000 untaxed. Every other heir is Class D, taxed at 15% on the first $700,000 and 16% above. The form's rates are per beneficiary.
A return is due within eight months of death, and unpaid tax earns 10% interest a year from then. The Division adds that a return is needed when property passes to someone other than Class A. Even a Class A estate may need the real estate waiver.
The Division says tax waivers are required to transfer a resident decedent's New Jersey real estate and that only the Inheritance Tax Branch issues them. Form L-9 can serve Class A heirs when the real estate waiver is the only reason to file. Form L-8 covers financial assets, not property.
Once your attorney says the personal representative may sign, compare a listing, a hold and an as-is cash sale. Ask for payoff numbers on loans and taxes first. A sale that nets less on paper can still beat months of carrying costs.

Only this branch issues the waiver for a decedent's New Jersey real estate.
Official pageMercer heirs can list the house, rent it or sell it as-is. A listing may bring a higher price when the home is in sound shape and the market is moving. A rowhouse with deferred maintenance, tenants or tax balances can take longer and cost more to prepare. Heirs who live out of state often value a firm date more than a top price.
Kaizen buys as-is for cash. We make an offer within 24 hours, charge no agent commission, ask for no repairs, and can close in 14 to 30 days or on your date. We do not control the Surrogate's schedule or the waiver, so we plan the closing around them. Call 267-329-0084.

The Surrogate passes on whether a will is valid and gives the executor proof of authority, per the county. Who inherits is decided by the will or by law if there is none. A dispute needs an attorney.
Class A heirs, such as a spouse or child, are exempt. Siblings, in-laws and other heirs can owe tax at the rates on the Division's form. Anyone selling real estate also needs the tax waiver, so a tax professional should review your file.
Often yes, but those items change the payoff and the timeline. Back taxes change the payoff, and tenants affect access. Tell us about both when you call. Your attorney should explain tenant rules before you promise a move-out.
We make an offer within 24 hours and can close in 14 to 30 days or on your date. The Surrogate's appointment and the tax waiver can set a later schedule. We plan around them and cannot speed them up.
