Essex County, NJ Probate Guide: Selling an Inherited House

Essex County estates often center on an older multifamily or a historic single-family home. A three-family in Newark, a two-family in Irvington or a pre-war house in Montclair brings tenants, permits and unit-count questions on top of the usual estate steps. The county Surrogate's Court names who may act, and the state's tax waiver clears the title.

This guide follows that order. It uses a neighboring office, Bergen County's Surrogate, as a reference for what a New Jersey Surrogate does. Call the Essex County office to confirm its address, hours and appointment rules. This is general information, not legal or tax advice.

Step by step in Essex County

  1. 1

Find the right Surrogate and ask what to bring

Probate belongs to the county where the person lived. For an Essex County resident, contact the Essex County Surrogate's Court directly and confirm its address, hours and whether visits are by appointment. Bergen County's office, next door, asks people to make an appointment first, which is a good sign to ask about here.

  2. 2

    Understand will versus no will

A Surrogate validates a will and appoints an executor, or appoints an administrator when someone dies without a will, as Bergen's office describes it. If heirs disagree about who should serve, talk to an estate attorney before you list the building.

  3. 3

    Classify each heir for tax

A spouse, child, grandchild or parent is Class A and exempt. A sibling or a child's spouse is Class C. Anyone else is Class D, taxed at 15% on the first $700,000 and 16% above. A bequest under $500 to one person is not taxed.

  4. 4

Get the waiver on the building

The Division says inheritance tax is a lien on all property owned at death, and written consent, a waiver, is needed to transfer it. Spouses holding as tenants by the entirety are the stated exception. A Newark or East Orange title company will ask for the waiver.

  5. 5

Gather the building facts a buyer will ask for

For a multifamily, collect the legal unit count, rent-control status, certificates, leases and permits for any conversions. For an East Orange condo or converted multifamily, add association and municipal approvals. For a Montclair or Bloomfield house in a historic district, confirm review requirements.

  6. 6

    Mind the eight-month deadline

The Division's guide sets the return and payment at eight months after death. Interest of 10% a year accrues after that. Vacant multifamilies can lose value quickly, so the deadline matters even when heirs are still deciding what to do.

  7. 7

    Compare sale routes

A listing may work for a Montclair house that shows well. A tenant-occupied Newark multifamily with deferred work may suit an as-is buyer. Ask your attorney who signs and get the waiver status in writing first.

Your selling options

Essex County heirs choose between listing, renting and selling as-is. A listing can be the right call for a well-kept Montclair or Bloomfield house with time to show. An occupied multifamily with deferred repairs, tenant questions and code items is harder to list, and each month adds taxes and upkeep.

Kaizen buys as-is for cash and makes an offer within 24 hours with no agent commission and no repairs. We can close in 14 to 30 days or on your date. The estate representative still has to sign, and the tax waiver has to be ready, so lean on your attorney for both. Call 267-329-0084.

Essex County probate questions

Who handles probate for an Essex County resident?

The Surrogate's Court of Essex County. Call the office to confirm its address, hours and appointment rules before you go. Bergen County's Surrogate, for comparison, asks visitors to book an appointment and keeps weekday hours.

Can I sell an inherited Newark multifamily with tenants in place?

Often yes, once the representative has authority and the waiver is arranged. Tenants, leases and the legal unit count will shape a buyer's offer, so collect them early. An estate attorney should guide the landlord duties during the estate.

Do my children owe inheritance tax on a house in East Orange?

Children are Class A heirs and are exempt under the Division's guide. A waiver is still required to transfer the real estate unless the property was held by spouses as tenants by the entirety.

What is the rate for a nephew or a friend?

They fall in Class D, which the Division taxes at 15% on the first $700,000 and 16% above that. Siblings are Class C. Have a tax professional apply the rates to the real values and confirm any exemptions.

How quickly can Kaizen close on an Essex County estate house?

Kaizen can offer within 24 hours and close in 14 to 30 days or on your date, with no repairs and no commission. For an estate, authority and the waiver set the real timing, so check both with your attorney.
