Essex County, NJ Foreclosure Guide: Multifamily Owners, Mediation and Options

Many Essex County owners live in a two-, three- or four-family house and rent out the other units. That matters in a foreclosure. The state's free mediation program covers owner-occupied one- to four-family homes that are the owner's primary residence, so an owner-occupant of a Newark three-family can qualify. An investor who lives elsewhere cannot. This guide walks through that and the court clock.

Kaizen's county notes describe Newark three- and four-unit buildings, East Orange high-rise and converted properties, Irvington two-families, and suburban Montclair and Bloomfield houses. They also flag tenant and probate complications. This is general information, not legal advice. A housing counselor or a New Jersey foreclosure attorney should review your papers.

Step by step in Essex County

  1. 1

Start with the Notice of Intent

A lender must send the Notice of Intent to Foreclose, and the borrower has 30 days from receipt to pay off the debt. File the notice with your loan papers and call a housing counselor the same week.

  2. 2

Decide whether you qualify for mediation

If you live in your Newark, East Orange or Irvington building as your primary residence, and it has no more than four units, you may qualify. Bankruptcy filers and non-occupant landlords do not. The request goes to the Superior Court Clerk's Office within 60 days of receiving the Summons and Complaint.

  3. 3

    Use a HUD-certified counselor

The court's flyer says you must obtain the help of a trained foreclosure counselor. Call the NJHMFA line at 609-278-7508 for a referral. A counselor can help you pull together the financial papers a lender asks for.

  4. 4

File an answer if you dispute the debt

The New Jersey Courts page gives 35 days to answer the complaint when you contest. The flyer says to consult a New Jersey licensed attorney in that case. Rent-controlled and occupied buildings add legal questions, so a lawyer's input is worth the cost.

  5. 5

    Learn the later deadlines

The Courts page lists a 14-day notice before entry of default and 45 days to cure. After judgment the sheriff has 150 days from the writ of execution to hold the sale, and each side may ask for two stays.

  6. 6

Ask the Essex County Sheriff for the sale terms

The county Sheriff's Office conducts the sale. Ask it for the current schedule, deposit and payment rules and how to check for changes, because this guide does not list them. Redemption is ten days after the sale, per the state.

  7. 7

    Gather the building file

Collect the legal unit count, rent-control status, certificates, leases and permits. A buyer, a lender and a court all ask for them. For a condo or converted multifamily, add association papers.

Your selling options

An Essex County owner can try a workout, sell with an agent, or sell as-is to an investor. A listing may work for a Montclair or Bloomfield house with time to show. A tenant-occupied Newark multifamily with deferred repairs is harder to list, and a calendar with a sale date is hard to beat.

Kaizen buys as-is for cash with an offer within 24 hours, no agent commission and no repairs on your side. We can close in 14 to 30 days or on your date. We cannot stop a sheriff's sale, so confirm timing with the lender's attorney and your own lawyer. Call 267-329-0084.

Essex County foreclosure questions

Can the owner of a three-family in Newark use free foreclosure mediation?

Possibly. The flyer covers owner-occupants of one- to four-family primary residences who are not in bankruptcy. If you live in one unit as your main home, a counselor or attorney can confirm eligibility.

I own a rental in East Orange and live elsewhere. Does mediation apply?

The flyer limits mediation to owner-occupants whose property is the primary residence, so a non-occupied rental generally does not qualify. An attorney can explain other options.

How many days do I have after the Notice of Intent?

The New Jersey Courts site says 30 days from receipt to pay off the debt. If a complaint is filed, the answer is due in 35 days when you contest.

Does mediation stop the sheriff sale?

No. The court says applying does not stop the lender from moving forward, and if a sale is scheduled you must file a motion asking the court to stay it.

Does Kaizen buy Essex County buildings in foreclosure?

Kaizen makes as-is cash offers and can close in 14 to 30 days or on your date. Tenants, leases and the lender's payoff shape the timing, and Kaizen does not control the court calendar.
