Bergen County, NJ Foreclosure Guide: Court Timeline and Sheriff Sale Rules

A Bergen County foreclosure runs through the New Jersey Superior Court, but the auction is run by the Bergen County Sheriff's Office in Hackensack. The Sheriff's own site spells out how bidding works, how much a winner must pay up front and how long before the balance is due. This guide combines those county rules with the state's court deadlines.

Bergen homes carry heavy property taxes, and Kaizen's notes list high carrying costs and dated homes in established suburbs among the common problems. Condo owners in Hackensack and Fort Lee also face association assessments that a buyer will want to see. This is general information, not legal advice. A housing counselor or attorney should review your case.

Step by step in Bergen County

  1. 1

Count 30 days from the Notice of Intent

The state's court page says the borrower has 30 days from receipt of the Notice of Intent to Foreclose to pay off the debt. This is your first and cheapest decision point. Call your servicer and a housing counselor right away.

  2. 2

    Answer the complaint on time

A contested case needs an answer within 35 days, per the Courts site. The state lists a 14-day notice before the lender requests entry of default, then a 45-day window to cure or make other arrangements. A Bergen County attorney can tell you how those apply to your case.

  3. 3

    Consider free mediation

If you live in the home as your primary residence, it is a one- to four-family property and you are not in bankruptcy, you can request mediation within 60 days of receiving the Summons and Complaint. You must work with a HUD-certified counselor, reachable through NJHMFA at 609-278-7508. Mediation does not stop the lender from proceeding.

  4. 4

    Watch the Sheriff's notices

Bergen County says sale listings are published on the Sheriff's website and in an online search portal. It warns that sales may be postponed, canceled or rescheduled because of adjournments, settlements or bankruptcy. Check the listing close to the date, not just once.

  5. 5

Know what happens at the auction

Sales are open bidding. The plaintiff opens at $100, the buyer pays 20% on the spot, and checks may not be dated earlier than 90 days before the sale. The balance is due within 30 days. You have ten calendar days to redeem after the sale, and the deed is delivered within 14 business days after full payment.

  6. 6

Use the property facts to plan

A Teaneck pre-war house may have permit questions on additions. A Paramus mid-century home may have a garage conversion. A Hackensack or Fort Lee condo requires association financials and assessments. Gather these records before you talk to buyers or agents.

  7. 7

Get a payoff before choosing a path

Ask the lender's attorney for a written payoff and sale date. If equity exists, a sale before the auction can protect it. If it does not, ask an attorney about lender approval and other options.

Your selling options

Some Bergen County owners have equity, which opens more doors than a thin-margin loan. A workout, a short sale or a regular listing could keep more of it, if there is time. Because a sheriff's sale can be postponed or run on a fixed date, the calendar matters more than any marketing plan.

Kaizen buys as-is for cash. We make an offer within 24 hours, charge no agent commission, require no repairs, and can close in 14 to 30 days or on your date. We cannot stop or delay an auction. Confirm timing with the lender's attorney and your own lawyer before signing. Call 267-329-0084.

Bergen County foreclosure questions

How does a Bergen County sheriff sale work?

It is an open auction. The plaintiff starts bidding at $100 and increments are $100, or $1,000 above $100,000. The winner pays 20% immediately and the balance within 30 days. Details and listings are on the Bergen County Sheriff's site.

Can my Bergen County sale be postponed?

The Sheriff says sales may be postponed, canceled or rescheduled because of adjournments, settlements or bankruptcy. The state also notes that both the debtor and the lender may request two stays each. Only the court, the Sheriff or the plaintiff's lawyer can confirm a change.

Can I get my house back after the auction?

The Sheriff's page says the original owner has ten calendar days to redeem after the sale. The state's court page gives the same ten days. Ask an attorney how redemption works and what you would have to pay.

Who qualifies for foreclosure mediation?

Owner-occupants of one- to four-family primary residences who are not in bankruptcy and who work with a trained counselor. You request it within 60 days of getting the Summons and Complaint. It is free, but it does not stop the foreclosure by itself.

Does Kaizen buy Bergen County houses in foreclosure?

Kaizen makes as-is cash offers and can close in 14 to 30 days or on your date. Whether a sale can finish before a sheriff sale depends on your lender, the payoff and the court, which Kaizen does not control.
