Facing Foreclosure in Morris County: Morristown Sheriff Sale and Mediation Guide

Morris County holds its sheriff sales every Thursday, excluding holidays, in a public meeting room in Morristown. That is a much faster cadence than counties that sell every other week. It also means a sale date, once set, can come around quickly. This page walks through the state process, the Morris rules and your options.

Morris homeowners tend to carry larger mortgages on bigger homes, and the cost of upkeep on those properties adds to the pressure. Older houses in Dover and town centers add their own repair bills. This is general information, not legal advice. A housing counselor or real estate attorney should review your papers.

Step by step in Morris County

  1. 1

Act on the Notice of Intent

The lender's Notice of Intent gives the borrower 30 days from receipt to pay off the debt or arrange an alternative, per New Jersey Courts. Record the date it came in. Call a counselor and the lender within the window.

  2. 2

Answer the complaint in 35 days

After the lender files, the case gets a docket number, and you have 35 days to answer. A missed answer lets the lender request default. Talk to a lawyer, or a legal aid office, before the clock runs out.

  3. 3

Request free mediation if you qualify

The Courts say free mediation is available and to ask as soon as possible after the foreclosure notice. Requests are due within 60 days of service of the summons and complaint. The home must be your primary residence of one to four units, all borrowers must join, and bankruptcy bars it. NJHMFA counseling is at 609-278-7508.

  4. 4

    Know the limits of mediation

The court form says mediation does not stop a foreclosure action. The lender can proceed in the meantime. Meet every deadline while you wait for a session.

  5. 5

Follow the writ and the 150 days

After judgment, the court issues a writ of execution, and the sheriff has 150 days to auction the property. Each side may request two stays.

  6. 6

    Learn the Morris sale rules

The minimum bid is $100. A third-party winner pays 20% of the bid, by cash, certified check or treasurer's, bank or cashier's check, and the balance within 30 calendar days. Interest runs from the eleventh day. Adjournments are requested by online form with payment before noon on the sale day.

  7. 7

Ask about the Community Wealth Preservation Program

The sheriff's page lists special terms for participants in the Community Wealth Preservation Program: a deposit of 3.5% of the original upset price and 90 days to pay, with interest from the 60th day. Ask the Sales Unit or your attorney whether you qualify. Check listings online or at the lobby computer, and remember the 10-day redemption window.

Your selling options

Pick the path that matches your equity. Mediation can lead to a loan modification or deed in lieu. A payment plan can work if the arrears are modest. A listing with an agent can bring the best price for a larger home in good shape, but showings and staging take weeks. Weekly sales leave little room for that.

Kaizen pays cash and buys as-is. Our offer arrives within 24 hours, with no agent commission and no repairs on your end, and closing can be 14 to 30 days out or on your date. We have no power to stop a Morristown sale. Only the plaintiff's attorney, the sheriff or the court can do that. Call 267-329-0084.
