Official pageForeclosure in Kent County follows Delaware's court process, and the county sheriff then runs the sale at the Levy Court building in Dover. Before the case is filed, the lender owes you a notice of intent and a 45-day wait on an owner-occupied home. After filing, the free state mediation program can pause a judgment while you talk with the lender.
No obligation. We respond within 24 hours.
Many Kent County owners are in modest detached or manufactured homes, and some are tied to Dover Air Force Base relocations. A move can matter, because mediation covers a home you live in as your primary residence. If you have already left the house, ask the hotline how your case is treated. This page is general information, not legal advice.
On an owner-occupied 1 to 4 family home, the lender cannot file until 45 days after it sends the notice of intent to foreclose. The notice goes by certified mail and first class mail. It must list housing counselors and the Attorney General's foreclosure hotline. Use those 45 days to call a counselor and gather your income papers.
The foreclosure case is a scire facias action on the mortgage. For covered homes, a notice of foreclosure mediation comes with the complaint. Do not set it aside. The 30-day counselor deadline and the mediation date both run from the date you were served.
The statute asks the defendant to meet with a HUD-approved housing counselor and file a Certificate of Participation within 30 days from service of the mediation notice. The state program itself is free. Call (800) 220-5424 if you do not know where to find a counselor.
The court sets the conference at least 45 days and at most 75 days after service. A judgment cannot be entered until the day after it. The state program lists loan modification, repayment plan and forbearance as ways to stay, and short sale or deed in lieu as ways to leave on better terms.
Before judgment or sheriff sale on an owner-occupied 1 to 4 family home, the plaintiff must file an affidavit about your chance to apply for a federal loss mitigation program. If it is missing, the judgment is dismissed without prejudice. An attorney can check the docket for it.
Kent County foreclosure sales happen on the first Thursday of the month in Chamber Room 203 at the Levy Court building. Bidders must register before the sale and bring a $4,000 non-refundable instrument for each property. The winning bidder pays 20% on the day of sale, and the page says the balance is due about 30 days later.
A buyer cannot price a fair offer without the lender's written payoff and the case status. If the home is worth more than the debt, a sale before the auction can protect your equity. If not, a counselor can explain what a short sale would need.

Free state mediation that can apply to Dover-area homeowners who live in the house. Hotline (800) 220-5424. Ask the staff about HUD-approved housing counseling before your 30-day deadline.
Official pageIf you want to keep the house, mediation is the main route, and a counselor can help you build the case for a modification or payment plan. If you want to leave, a short sale, a deed in lieu, a listing with an agent or a sale to an investor each fit different situations. A listing can reach more buyers but needs time and a house that shows well. A manufactured or rural home may take longer to sell retail.
Kaizen buys as-is for cash. We make an offer within 24 hours, charge no agent commission, require no repairs, and can close in 14 to 30 days or on your date. We cannot promise to stop or delay a sheriff sale. The lender, the court and the payoff decide that. Ask your attorney about timing, then call 267-329-0084.
The Sheriff's Office page says foreclosure sales are held on the first Thursday of each month unless a holiday falls on that day. Sales take place at the Levy Court building, 555 Bay Road in Dover, in Chamber Room 203.
The Sheriff's page says there is not a redemption period for a foreclosure sale, unlike a tax sale where the owner has about 90 days. That makes acting before the sale important. An attorney can explain any court options.
It is a free program started on January 19, 2012 that gives homeowners in covered foreclosures a face-to-face talk with the lender. The statute says no judgment can be entered until the day after the scheduled mediation conference.
Bidders bring a $4,000 non-refundable cashier's check, certified check or money order for each property. The winning bidder pays 20% of the bid on sale day, and the balance is due later, according to the Sheriff's page.
Kaizen makes as-is cash offers and can close in 14 to 30 days or on your date, with no repairs and no agent commission. Whether it can finish before a sale depends on your lender and the court, which we do not control.
