Large homes, old farmhouses and rural lots can be hard to value, and a lender's payoff may be close to or above the price. Owners who carry a big mortgage on a property with septic, well and upkeep needs often look at selling early. This is general information, not legal advice. A housing counselor or real estate attorney should review your papers.

Step by step in Hunterdon County

  1. 1

Take the Notice of Intent seriously

New Jersey Courts says the borrower has 30 days from receipt of the Notice of Intent to pay or arrange an alternative. The window is short. Call the lender, then call a counselor, and keep notes of who said what.

  2. 2

File an answer within 35 days

After the lender files the complaint, you have 35 days to answer. Without an answer, the lender can ask for default. Consider talking to a lawyer; the court's own guides say foreclosure cases can be complex.

  3. 3

Request free mediation if you qualify

Mediation is free and the court says to ask early. The request is due within 60 days of service, the home must be your primary residence of one to four units, and all borrowers must agree. The court form says you cannot be in bankruptcy. Housing counselor help starts at NJHMFA, 609-278-7508.

  4. 4

Know what mediation can and cannot do

The court form says mediation does not stop a foreclosure case. It is a place to ask about a loan modification or a deed in lieu. Keep your court deadlines while you wait for a session.

  5. 5

Track the writ and the 150 days

After final judgment, the court issues a writ of execution. The sheriff has 150 days from the writ to auction the home, and each side may request two stays. Hunterdon says to check the website or call on the scheduled sale date, since sales can be adjourned.

  6. 6

    Understand the Flemington auction

Sales are open auctions with no sealed bids. The plaintiff opens at $100, and later bids are at least $100 more. The winner posts 20% right away by certified, cashier's or treasurer's check and pays the balance within 20 calendar days. Interest accrues if the balance is unpaid after ten days.

  7. 7

Plan before the hammer, and know the redemption window

The original owner can redeem within ten calendar days. A sale before the auction may protect equity. Get a written payoff and ask your attorney or counselor whether it fits.

Several paths may be open. A loan modification from mediation, a payment plan, a deed in lieu, a listing with an agent or an investor sale each suit different facts. A well kept home on a good lot might net the most from a listing, if you have the weeks it takes. A house with deferred upkeep may need a faster route.

Hunterdon County foreclosure questions

When are Hunterdon County sheriff sales?

Sales are held every other Wednesday at 2 pm at the Main Street County Complex, Building 1, 2nd Floor, 71 Main Street, Flemington. Call 908-788-1166 or check the county website on the sale date, because sales can be adjourned.

Do bidders at a Hunterdon sale need to register?

Yes. The county says persons expecting to bid should register with the Sheriff's Office before the sale. Sales are open auctions with no sealed bids.

How long does a winning bidder have to pay?

The deposit of 20% is due right away. The balance is due within 20 calendar days of the sale, and interest accrues if it is unpaid after ten days. The sheriff's deed follows within 30 days of full payment.

Can I stop a Hunterdon sale with mediation?

Not by itself. The court form says mediation does not stop a foreclosure action. It can lead to a loan modification or other deal, but you still need to meet court deadlines and request any stays your attorney advises.

Does Kaizen buy Hunterdon County homes in foreclosure?

Kaizen makes as-is cash offers and can close in 14 to 30 days or on your date, with no repairs and no agent commission. Whether a closing can beat the auction depends on your lender, the payoff and the court docket. We do not control those.
