Owners here include inland commuters in Freehold or Middletown, and shore owners in Long Branch, Asbury Park and Neptune where insurance, flood exposure and carrying costs are high. A mortgage plus those costs can fall behind quickly. This is general information, not legal advice. A housing counselor or real estate attorney should review your papers.

Step by step in Monmouth County

  1. 1

Act on the Notice of Intent

New Jersey Courts says a borrower has 30 days from receiving the Notice of Intent to pay off the debt or arrange an alternative. Record the arrival date. Call a counselor early so the lender sees a complete application.

  2. 2

Answer the complaint in 35 days

When the lender sues, the case gets a docket number and you have 35 days to answer. A missed answer lets the lender request default. Consider an attorney or legal aid. Foreclosure rules are strict.

  3. 3

Ask about mediation within 60 days

Free foreclosure mediation is available. The request is due within 60 days of service of the summons and complaint. The home must be your primary residence of one to four units, every borrower must join, and bankruptcy bars it. Counselor help starts at NJHMFA, 609-278-7508.

  4. 4

Do not expect mediation to stop the sale

The court form says mediation does not stop the foreclosure case. It can lead to a modification, but the lender can keep going. Keep every date on your calendar.

  5. 5

    Count the 150 days

After a final judgment, a writ of execution is issued. The sheriff has 150 days from that writ to auction the property. Each side may request two stays to delay the sale.

  6. 6

    Read the Freehold sale rules

The opening bid is $1,000 and bids rise by $1,000. The winning bidder pays 20% right away, in cash up to $1,000 or by certified check, and the balance within 30 days. Interest accrues after 10 days. The county says the office will not recognize a right of refusal except for homeowners in the Community Wealth Preservation Program.

  7. 7

Check the status and the redemption window

The updated list is on view at the Public Safety Building weekdays from 8:30 AM to 4:30 PM and online at salesweb.civilview.com/Sales/SalesSearch?countyId=8. After a sale, the owner can redeem for up to 10 days. Get a written payoff before any sale decision.

Your selling options

The right option turns on equity and time. Mediation can produce a loan modification or deed in lieu. A repayment plan may work if the arrears are small. A listing can bring the best price for a house in good shape. Shore homes that need elevation work or repairs often take longer to sell retail.

Kaizen can make an as-is cash offer within 24 hours. There is no agent commission and no repair list, and closing can be in 14 to 30 days or on your date. A shore house with flood or elevation problems is priced as it stands. We cannot stop or delay a Freehold sale; the plaintiff's attorney, the sheriff or the court has that power. Call 267-329-0084.
